Washington Retail Theft Degrees & Merchandise Values

Washington generally classifies retail theft according to the value of the property or services involved. The degree determines whether the alleged offense is a gross misdemeanor or felony.

The value-based theft classifications generally include:

  • Theft in the third degree: Property or services valued at $750 or less. This offense is a gross misdemeanor.
  • Theft in the second degree: Property or services valued at more than $750 but no more than $5,000. This offense is a class C felony.
  • Theft in the first degree: Property or services valued at more than $5,000. This offense is generally a class B felony, although statutory exceptions may apply.

A retailer’s civil demand is separate from a criminal prosecution. Washington law permits civil claims in certain cases involving the alleged conversion of merchandise, and the retailer doesn’t need a criminal conviction to pursue such a claim. A written demand must explain that payment doesn’t prevent criminal prosecution.

A store ban, police report, civil claim, and court case may each require a different response. Paying the requested amount doesn’t automatically dismiss or prevent a theft charge.
