First Offense DUI in Pullman
Prepare for Both Proceedings After a First-Time DUI Arrest
A DUI arrest can lead to two separate proceedings, unfamiliar court obligations, and serious questions about driving privileges. At Baumgarten Law Offices PLLC, we address both the criminal case and the administrative licensing matter. Most DUI cases arising in Pullman are heard in Whitman County District Court, and our familiarity with that setting helps us prepare clients for what comes next.
Attorney Luke Baumgarten’s former prosecutorial experience informs how we evaluate evidence, charging decisions, and possible resolutions. Our firm has more than 50 years of combined experience and has represented clients across Washington since 2014.

What Counts As a First Offense Under Washington Law?
A driver age 21 or older may face a DUI charge for operating a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher. BAC measures the amount of alcohol in a person’s bloodstream. For drivers under 21, the applicable threshold is 0.02%.
Not every Washington State University student is under 21, so the threshold depends on the driver’s age. A case may also involve other evidence of impairment, making it important to examine the entire arrest rather than focus only on a reported test number.
First-offense status isn’t determined solely by whether someone has previously been convicted of DUI. For sentencing, Washington courts count qualifying offenses with arrest dates within seven years before or after the current arrest date. We review each client’s record and the relevant dates before assessing the potential sentencing category.
Potential Penalties for a First Offense in Pullman
When there’s no prior offense within seven years and the BAC is below 0.15%, or there’s no test result, Washington law provides a statutory minimum of 24 consecutive hours in jail. The statutory fine ranges from $350 to $5,000. These ranges don’t predict the sentence in an individual case.
In this category, a court may substitute at least 15 days of electronic home monitoring or a 90-day 24/7 sobriety program for the minimum jail term. The 24/7 sobriety program is a court-supervised alcohol-testing option. Eligibility and the terms imposed depend on the case and the court’s decision.
A BAC of 0.15% or higher, or a refusal to submit to testing, raises the statutory minimum to 48 consecutive hours in jail. Longer electronic home monitoring or 24/7 sobriety-program alternatives may apply to that sentencing tier.
The Department of Licensing addresses driving privileges separately from the criminal court. License restrictions and ignition-interlock requirements require their own evaluation because the criminal sentence alone doesn’t resolve them. We consider both tracks when advising clients about immediate obligations and possible consequences.
How the Criminal & Licensing Proceedings Unfold
A DUI case commonly begins with arrest and booking. An initial court appearance and plea entry often occur within a few days, although timing varies. Pretrial proceedings follow and may include motions addressing legal issues before trial.
The case may resolve during the pretrial stage or proceed to trial, depending on the evidence, disputed legal questions, and positions of the parties. A conviction or guilty plea is followed by sentencing. We explain each stage so clients can make informed decisions based on the path their case takes.
The Department of Licensing matter follows a separate and generally faster track. Its hearing is typically conducted by phone with a hearing officer rather than in Whitman County District Court. Responding to one proceeding doesn’t resolve the other.
Building a Defense Around the Evidence
First-time DUI representation in Pullman begins with the circumstances of the stop, arrest, and chemical testing. We examine whether law enforcement had lawful grounds for the arrest and followed constitutional and testing requirements.
Potential defense challenges may include:
- Tampered test results
- Wrongful arrest
- Illegal checkpoint arrest
- Search-and-seizure violations
- Improperly calibrated breath-testing equipment
- Improperly administered chemical testing
Attorney Baumgarten is a member of the National College for DUI Defense and has been named to The National Trial Lawyers: Top 100 Lawyers. We apply this DUI-focused background when reviewing testing procedures, police conduct, and pretrial issues.
Possible Reduction to Negligent Driving in the First Degree
When the evidence and legal issues justify it, a prosecutor may agree to reduce a DUI charge to Negligent Driving in the First Degree. This misdemeanor is punishable by up to 90 days in jail and a fine. Any reduction or dismissal depends on the evidence, legal challenges, and circumstances of the individual case.
A Negligent Driving in the First Degree conviction doesn’t carry the mandatory ignition-interlock requirement associated with a DUI conviction unless there’s a prior offense within seven years. In that situation, a six-month ignition-interlock requirement applies. We evaluate any proposed resolution in light of both criminal penalties and driving consequences.
